LANKAN FEST 2025 STALL HOLDER AGREEMENT – TERMS AND CONDITIONS FOR VENDORS

Background

a. This document sets out the official Terms and Conditions governing participation in Lankan Fest 2025. b. By applying for and/or paying for a stall at Lankan Fest 2025, vendors acknowledge that they have read, understood, and agreed to comply with these Terms and Conditions in full. c. These Terms and Conditions form a binding agreement between the applicant (stallholder) and Future Foundation for Kids Inc. (Lessor). d. LANKAN FEST reserves the right to cancel, waive, or amend any terms and conditions prior to the commencement of the event after giving due notice.

1. Definitions

1.1 In this Agreement:

  • Application means the submission of the official application form with all required attachments.

  • Approved Product means those goods and services listed in the stallholder’s Application for which the LANKAN FEST Coordinator has provided written consent to sell at the event.

  • LANKAN FEST means the Future Foundation for Kids Inc. and Lankan Fest Inc.

  • Lankan Fest 2025 means the festival event held on Sunday, 16 November 2025, at Crown Riverwalk, Melbourne, VIC, Australia.

  • LANKAN FEST Coordinator means the Event and Sponsorship Coordinator or other staff member appointed by LANKAN FEST.

  • Rules and Regulations means the terms and conditions outlined in this document.

  • Stall means the 3m x 3m or 6m x 3m area within the event designated for trading.

  • Stallholder means a person, persons, or entity approved to trade at the event.

  • Refundable Deposit means the security amount paid by the Stallholder as outlined in Clause 3.

  • Trading Activity means the offering of goods or services for sale to the public.

2. Terms and Conditions

2.1 Approved Products

  • Stallholders may sell only the Approved Products listed in their application.

  • The LANKAN FEST Coordinator may cancel a stallholder’s approval if unapproved or unsafe products are sold.

2.2 Prohibited Products

  • Sale or display of political, offensive, illegal, counterfeit, or unlicensed goods is strictly prohibited.

2.3 Insurance Requirement

  • All stallholders must hold valid Public Liability Insurance for a minimum of AUD $10 million and submit proof of cover prior to the event.

2.4 Fees and Payments

  • Stall fees and deposits must be paid in full prior to the event.

  • Fees are non-refundable except in the event of cancellation by LANKAN FEST.

2.5 Trading Hours

  • The event operates from 10:00 AM to 8:00 PM on Sunday, 16 November 2025.

  • Stalls must be fully set up before opening and packed down only after official closing times.

2.6 Site Maintenance

  • Stalls must be kept clean, tidy, and safe. Waste, oil, or debris must be properly disposed of at the end of the event.

  • Any damage caused by a stallholder will result in deductions from the refundable deposit and may affect participation in future events.

3. Refundable Deposit

3.1 A refundable deposit of AUD $500.00 is payable with the stallholder’s application.

3.2 The deposit serves as a bond to cover potential damages, cleaning costs, or breaches of these Terms and Conditions.

3.3 The refundable deposit will be returned within 10 business days following the event, provided that:

  • No damage has occurred to event property, marquees, or facilities;

  • The stall area has been left clean and tidy;

  • All terms of this Agreement have been met.

3.4 LANKAN FEST reserves the right to retain part or all of the deposit for any damage, non-compliance, or cleaning required after the event.

4. Code of Conduct

  • Stallholders must act respectfully towards staff, other vendors, and patrons.

  • Harassment, discrimination, or aggressive behaviour will not be tolerated.

  • Consumption of alcohol or illegal substances while trading is prohibited.

  • Amplified sound or music is not allowed without prior written consent.

5. Liability and Indemnity

5.1 LANKAN FEST and Future Foundation for Kids Inc. accept no liability for theft, loss, or damage to stock, equipment, or property.

5.2 Stallholders agree to indemnify and hold harmless LANKAN FEST, its organisers, staff, and volunteers against any claims, losses, or damages arising from their participation in the event.

6. Miscellaneous

6.1 These Terms and Conditions constitute the entire agreement between the parties. 6.2 Stallholders may not assign or transfer their participation or rights. 6.3 Each party bears its own costs related to participation and compliance. 6.4 This Agreement is governed by the laws of the State of Victoria, Australia.

Binding Agreement

By submitting an application and/or making payment for a stall at Lankan Fest 2025, the stallholder acknowledges that they are legally bound by these Terms and Conditions and agree to comply with all requirements outlined herein.
